Private parking charge vs council Penalty Charge Notice
Issued by a private operator on private land. Based on a contractual term or trespass. Enforced through civil claims, not through criminal law.
Issued by a local authority for a parking contravention on public land or under traffic regulation. Backed by statutory enforcement processes.
ANPR, signage and contractual terms
- ANPR
Automatic Number Plate Recognition cameras record vehicle entry and exit times. A charge may be calculated from the difference.
- Signage
The terms on which a motorist is said to have agreed are usually set out on signs. The adequacy and visibility of signage is often central to a dispute.
- Contractual terms
A private charge is generally framed as a contractual term the motorist accepted by parking, or as a response to trespass.
- Keeper liability
Under the Protection of Freedoms Act 2012, a keeper may become liable for a charge if the driver is not identified and certain conditions are met.
The appeals ladder
There is generally an internal appeal to the operator first, then an independent appeal body where applicable.

- 2If rejected, independent appeal to POPLA (Parking on Private Land Appeals) where the operator is a member of the British Parking Association's Approved Operator Scheme.
